1. Agreement to Terms
By accessing or using the RapportAgent website (www.rapportagent.com) or any of our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms constitute a legally binding agreement between you and RapportAgent.
2. Description of Service
RapportAgent provides AI-powered lead response agents for home service businesses. Our agents engage website visitors, qualify leads, and book appointments via chat, SMS, and voice channels. The service is provided on a subscription basis with features and availability as described on our website at the time of purchase.
3. Account Registration
To use certain features of our service, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to: use the service for any unlawful purpose; transmit harmful, offensive, or deceptive content through our agents; attempt to reverse-engineer, decompile, or disassemble our technology; interfere with the proper functioning of the service; use the service to send unsolicited messages (spam); or misrepresent yourself or your business when using our agents.
5. Intellectual Property
All content, features, and functionality of the RapportAgent platform — including but not limited to AI models, conversation scripts, software, text, graphics, and logos — are owned by RapportAgent and protected by intellectual property laws. You retain ownership of your business data and customer information processed through our service.
6. AI-Generated Content
Our agents generate responses using artificial intelligence. While we strive for accuracy, AI-generated responses may occasionally be inaccurate or incomplete. You are responsible for reviewing and verifying any information provided by our agents to your customers. RapportAgent does not guarantee the accuracy of AI-generated content.
7. Payment Terms
Subscription fees are billed according to the plan selected during signup. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
8. Warranties and Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. We do not guarantee specific lead conversion rates, response accuracy, or business outcomes. Results vary based on industry, configuration, and market conditions.
9. Limitation of Liability
To the maximum extent permitted by law, RapportAgent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, regardless of the cause of action. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless RapportAgent, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, your violation of these terms, or your violation of any rights of a third party.
11. Termination
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings or by contacting us. We may suspend or terminate your access if you violate these terms or for any other reason with reasonable notice. Upon termination, your right to use the service ceases immediately. We will provide your data for export upon request within 30 days of termination.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in Massachusetts.
13. Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of material changes by posting the updated terms on this page with a revised effective date. Your continued use of the service after changes constitutes acceptance of the modified terms.
